Abstract:
The Separation of Ancillary Services and The Structural Separation of The Telecommunications Network Article 47 c. 2 quater of the decree law n. 5/2012, so-called “Semplifica Italia”, requires national regulatory authority for communication (Autorità per le garanzie nelle comunicazioni – Agcom) to identify the necessary measures to enable the local loop unbundling so that the ancillary services, such as maintenance and activation of line, are available by operators other than the incumbent operator Telecom Italia. In practice, the provision imposes the unbundling of ancillary services. This would be contrary to the European regulation on electronic communications for three reasons: first, only the national regulatory authority has competence to exercise ex ante regulatory powers; secondly, the unbundling of individual services is an atypical remedy; third, European controls on the imposition of ex ante obligations would have been evaded. The C.ssion has therefore decided to start the procedure of infringement. In this work we analyze the supposed conflict and the possible consequences. Furthermore, the rule is evaluated in the light of the announced structural separation of the network and in relation to the advent of the Next Generation Networks (NGN).
