Abstract:
The Aeegsi was established by Law no. 481/1995 and began its operations in 1997; after twenty years it is possible to make a balance on centralised regulation of some public services and on the many tasks performed by administrative procedures and measures, based on national and EU sectorial disciplines. The determination of tariffs for services is undoubtedly a difficult task that has been built over time through participation and consultations of economic operators, frequently applied by the Aeegsi; the adversarial principle acquired a particular depth in the penalty proceedings and in alternative dispute resolution. In a more general sense, the contribution of the Authority was very significant for the evolution of some aspects of the administrative procedures not provided for by law n. 241 of 1990 and the interpretation of the technical discretion, considered the relevant litigation submitted to the administrative judge. An inevitable further innovation could consist in the allocation of the waste sector regulation, as evidenced by the draft legislative decree on local public services (withdrawn in late November 2016, following the Constitutional Court judgment no. 251/2016) also according to the opinion of the State Council expressed in January 2017.
